Please read these Terms and Conditions of use ('Terms') carefully before using the 'chiropracticheaven.com' website (the 'Website'). These terms apply to all users of this Website whether you are a registered user or just visiting the Website. By using this Website you agree to be bound by these Terms, if you do not accept these terms you must not access the Website.

This Website is owned and operated by Chimes Chiropractic Ltd, a UK based limited company.

Chiropracticheaven.com provides a 2 year eLearning course broken down into 120 weekly modules. To gain access to the eLearning modules you must subscribe to chiropracticheaven.com as a member and pay a monthly subscription. Chiropracticheaven.com also sells DVD's, CD's and other products in its on-line store. You do not need to be a member of chiropracticheaven.com to gain access to and purchase goods from the on-line store. Chiropracticheaven.com does not sell electrical goods of any kind.

Chiropracticheaven.com runs a Returns Policy and a Refunds Policy for items that are damaged or incorrect. Please click on the links above to read the terms and conditions of these policies.

Chiropracticheaven.com endeavours to send all goods ordered from its on-line store to you within 7 days of the order. When you make an order the order will be confirmed to you by e-mail. If the goods you have ordered are not currently in stock we will notify you of this by e-mail and you will have an opportunity to cancel the order if you wish. Although chiropracticheaven.com endeavours to send any ordered goods to you within 7 days of the order we cannot be held responsible for the actions of the postal or courier services with regard to delivery times. However, we are responsible to you if you do not receive the goods or they arrive to you in a damaged state - under these circumstances please refer to the Returns Policy and the Refunds Policy.

All transactions made between clients, members and customers on chiropracticheaven.com are made in US Dollars.

Purpose of the Website
Chiropracticheaven.com is directed at Doctors of Chiropractic, Chiropractic practice owners and their staff. The eLearning modules contained on the site are designed to offer a 2 year course in practice management. You may use the Website by becoming a member and paying a monthly subscription. The course has three levels: Silver, Gold and Platinum. There are more details in the How the Website Works section.

As the course progresses and the modules are completed you should find that your practice grows, your patients are happier and in turn your income from the practice increases. However, this will only happen if you implement and use the systems and techniques contained within the modules. Although the Website is not designed for or directed at anyone under the age of 18, the contents of the Website are entirely suitable for anyone under the age of 18.

Chiropracticheaven.com Forum
As a subscriber to the chiropracticheaven.com website you will be able to post and reply to messages on the Website forum.

As a subscriber to the chiropracticheaven.com website, you undertake that all of the information you provide when you register is complete and accurate, including your name, contact details and e-mail address. You must keep this information up to date at all times.

When you register to use the chiropracticheaven.com forum you will be asked to select a user name and password. As you will be responsible for all activities that occur under your user name and password, you should take care to keep your user name and password confidential. You must notify us immediately of any unauthorised use of your user name or password or if you believe that your user name or password are no longer confidential. We reserve the right to require you to alter your username and password if we believe that they are no longer secure.

We may reserve the right to refuse to accept your application to register for the forum for any reason at our absolute discretion.

When you register for forum membership you additionally agree to use the chiropracticheaven.com forums in accordance with our Forum Rules which outline appropriate levels of behaviour when posting messages and the subject areas that may be discussed on the chiropracticheaven.com forums.

By posting a message on the chiropracticheaven.com forums you warrant that your message complies with the Terms and Conditions, forum rules and/or any relevant laws and regulations in force from time to time and agree to indemnify chiropracticheaven.com against all legal fees, damages and other expenses that may be incurred by chiropracticheaven.com as a result of your breach of this warranty.

If you discover any material or behaviour of other users which you think is unacceptable or in breach of these Terms and Conditions and/or our forum rules you should report it to us using the Notice of Defamatory Content and we will deal with it at our discretion.

In the event that you breach any of the provisions above, chiropracticheaven.com reserves its right to remove that content or disable access to it and to respond to any complaints made by a third party in respect of that content. chiropracticheaven.com will not be liable to you if it removes any content where it believes that such content breaches the provisions of these Terms. Chiropracticheaven.com will have the right without notice to record the IP address from which any user submitted content is transmitted or communicated through this Website. Chiropracticheaven.com may also preserve any content that you send or receive if required to do so by law or if reasonably required to ensure compliance with the Terms or to respond to third party complaints about such content.

If you post any comments or content on the Website you grant chiropracticheaven.com a non-exclusive royalty free perpetual irrevocable right and licence to reproduce, modify, edit, adapt, publish, translate, distribute and display such materials in any and all media now known or in future created throughout the world and authorise others to do so. You further agree to irrevocably and unconditionally waive all moral rights which you may have in respect of any material posted by you on the Website.

Disclaimer and Limitation of Liability
The content and search facility of the Website is provided to you on an 'as is' basis by way of general information only. You accept and acknowledge that we shall not in any way be liable for any damage, loss, costs or expenses arising directly or indirectly from your reliance on or use of the Website, or any information contained therein. In addition, we make no representations or warranties about the accuracy, completeness or suitability for purpose of the information and related graphics published in the Website.

You agree to indemnify fully and hold chiropracticheaven.com indemnified from and against any claim brought by a third party resulting from the use of the Website, and/or the chiropracticheaven.com materials and any associated facilities provided by chiropracticheaven.com, and in respect of all losses, costs, actions, claims, expenses or liabilities whatsoever suffered or incurred directly by chiropracticheaven.com, in consequence of your breach or non-observance of the Terms and/or forum rules.

Chiropracticheaven.com's aggregate liability and that of its suppliers in contract, tort or otherwise including negligence shall be limited to £25 in respect of one incident or series of incidents arising from a common cause in any 12 month period.

You acknowledge that you are responsible for making back-up copies of all your data and taking appropriate precautions against viruses, hacking and all other types of computer misuse.

Whilst we try to ensure that the Website does not contain any error, defect, malfunction or corruption, we do not accept responsibility for any damage to or loss of data on your computer system, network or server that results from the download or use of the Website or any materials made available on the Website.

We shall not be liable to you for any of the following types of loss or damage arising out of or in connection with your use of the Website or any content and/or facilities provided by the Website including:

Availability
We cannot promise that access to the Website will be uninterrupted or error free, but we endeavour to ensure that the Website is available 24 hours a day 7 days a week. However there will be occasions when the Website is interrupted for maintenance, upgrades and emergency repairs. We will try to keep such interruptions to a minimum. You agree that we shall not be liable to you, or any third party, for any modification, suspension or discontinuance of the Website. Access may also be interrupted due to failures of telecommunications links and equipment beyond our control.

You accept that you will not have a claim for breach of contract or otherwise in respect of such periods of unavailability. You also acknowledge that we cannot be held responsible for any delay or disruptions that are inherent in the operation of the Internet and the World Wide Web, including viruses.

General
If any provision of these Terms becomes void or otherwise unenforceable in whole or in part, the validity of the remainder of these Terms shall not be affected.

If either we or you fail to enforce, or delay in enforcing, any of our respective rights or remedies under these Terms, such failure or delay shall not operate as an agreement to waive that right or remedy and shall not prevent us from exercising that right or remedy in the future.

These Terms are governed by and will be construed in accordance with the laws of England and Wales unless you live in Scotland in which case it will be governed by Scots law and the relevant courts of the UK will have non-exclusive jurisdiction in relation to their Terms.

We reserve the right to amend these Terms from time to time. When we make a change we will update this page of the Website. If we do so, the updated version will be effective as soon as it is uploaded on to this Website. The date of the last revision to these Terms is provided at the end of the Terms. We recommend that you visit this page each time you visit the Website to ensure that you are aware of and are complying with any changes that we have made to these Terms. If you continue to use the Website you will be deemed to have accepted those changes from the point at which these changes come into effect.

How the Website Works
Before committing to subscribe to the chiropracticheaven.com website you will be given the opportunity to undergo a $20 Trial which will offer the first month for $20.

However, in order to gain access to the $20 Trial you must provide us with all your relevant contact information and your Credit Card information.

Just before the start of the second month your first full subscription fee will be deducted from your Credit Card Account. This subscription fee will entitle you to a further one month. The next month's modules will not be released until your payment has cleared. You can always check the date of your next due payment on the Your Account page.

There are 120 modules in total. It is recommended that you complete all 120 modules if you wish to get the best result from the chiropracticheaven.com website. Most of these modules, but not necessarily all, will contain text, video clips and pdf downloads. Chiropracticheaven.com reserve the right to add or subtract modules at their absolute discretion. At the end of each month there will be a Review of the previous months material.

There are three bands of membership to the chiropracticheaven.com website.
Silver Entitles you to one month's subscription.
Cost: $150 USD per month (£89 (incl. VAT) or €100)
Gold Entitles you to one month's subscription, one Audio CD and one DVD per month, monthly Articles and Newsletters.
Cost: $299 USD per month (£175 (incl. VAT) or €200)
Platinum Entitles you to one month's subscription, one Audio CD and one DVD per month, monthly Articles and Newsletters, four seminars per year and telephone and e-mail coaching.
Cost: $849 USD per month (£489 (incl. VAT) or €550)

PLEASE NOTE: You may also pay in Pounds Sterling (UK) or Euros, however exchange rates are changed on the absolute discretion of chiropracticheaven.com and do not reflect daily fluctuations. The currency you are charged in will be set automatically based on which country you are registering from, however you may change the currency you wish to pay with at the bottom of the Personal Details link in the Your Account page. Chiropracticheaven.com can take no responsibility for credit card company fees or charges due to you choosing to pay in a foreign currency.

For UK residents, all membership fees are subject to Value Added Tax (for more information see 15. Taxation).

Chiropracticheaven.com, Chimes Chiropractic Ltd, or Chimes Consulting cannot be held liable for the success, lack of success or otherwise of any other action of a Doctor, practice or staff performance due to interaction with the chiropracticheaven.com website.

Further to this it must be understood that this is a global tuition program and that regulations differ from country to country and state to state. It is the responsibility of the Doctor and practice owner to ensure that their practice acts within the rules and regulations of their own territory and chiropracticheaven.com - Chimes Chiropractic Ltd, or Chimes Consulting cannot be held liable for any Doctor, practice, staff member or practice owner breaking those rules and regulations due to advice given on this Website. Furthermore chiropracticheaven.com reserve the right to change, modify or amend content of the site at their sole discretion without warning to a user.

Upgrades
As a Silver or Gold member you may upgrade to the next level at any time during the program. However, if you upgrade part way through the program you will only be supplied the backdated CD's and DVD's if you pay the balance. You will be asked via e-mail if you would like to take this option and if you agree your Account will be debited and the products sent out to you. You may also downgrade your membership at any time.

Guarantee
As part of our guarantee you may leave the program at any time with no penalties. You are not committed to a full year or any term of membership by subscribing to the site. However, we do ask that you give us 30 days notice that you wish to leave the program. This may mean that you will incur one month's subscription charge.


Conditions relating to your use of chiropracticheaven.com

1. Your Account
If you use the Website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. Chiropracticheaven.com reserves the right to refuse access to the Website, terminate accounts, remove or edit content or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

2. Privacy

3. Access to chiropracticheaven.com
We will do our utmost to ensure that availability of the Website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the Website may also be suspended occasionally or restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

From time to time the eLearning modules will instruct you to download certain pdf documents to aid your education. This licence does not include any resale or commercial use of this Website or its contents; any collection and use of any product listings, descriptions or prices; any derivative use of this Website or its contents; any downloading or copying of account information for the benefit of another merchant or any use of data mining, robots, or similar data gathering and extraction tools.

This Website or any portion of this Website may not be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose without our express written consent.

12. Returns
Please review our Returns Policy, which applies to products purchased from us. In addition to your 30-day returns guarantee, customers in the European Union are entitled to a statutory cooling-off period of seven business days. PLEASE NOTE: We are unable to exchange items that are not damaged, defective or incorrect.

To ensure the safe return of your items and the correct allocation of the items to your order, please follow the guidelines below:
  • Please use the original cardboard box and the manufacturer's original package to return the item.
  • Please include the payslip (the original or a copy). If you have lost the payslip then you must include the Returns Form with the name of the person who ordered the items, the order number and the reason for the return.
  • If you no longer have the original cardboard box, please ensure the package you return the item in is adequate and strong enough to hold the package whilst in transit.

Our 30-day returns guarantee means that if for any reason you are unhappy with your purchase, you can return it to us in its original condition within 30 days of the date you received the item, unopened (with any seals and shrink-wrap intact) and we will issue a full refund for the price you paid for the item.

PLEASE NOTE: We can only accept the return of opened items if they are faulty. This returns policy does not affect your statutory rights. Specific rules apply regarding refunds of delivery charges, and other services - see our Refunds Policy.

In the event of chiropracticheaven.com sending you a replacement for a damaged, defective or wrong item, you must return the item to chiropracticheaven.com within 30 days. Chiropracticheaven.com reserves the right to charge the price of the replacement item to the payment card used for the original order if you do not return the original item to us within 30 days of the date on which chiropracticheaven.com confirms we will issue a replacement.

Refunds Policy

Our Refunds Policy does not affect your statutory rights. Some notes about refunds:
  • When you send your item back to us we'll process the returned item then notify you via e-mail of your refund. You can expect a refund in the same form of payment originally used for purchase within three weeks of our receiving your return.
  • Please always obtain proof of postage of any item returned to us. In the event of a dispute you may be asked to produce this proof.

Items returned because they are damaged, defective or incorrect

Items returned within the seven-day cooling off period
